What is Jailbreaking an iPhone?

Jailbreaking is the process of installing a custom built firmware that has broken Apple's security protocols to allow you to access system files. To unlock your iPhone to use any carrier, you must first Jailbreak your iPhone. In short, Jailbreak is the process of hacking an iPhone to free it from Apple restrictions.

Jailbreaking your iPhone is mainly used to allow you to install third-party applications not authorised by Apple and to provide you with the ability to use other phone companies and carriers. Once jailbroken, iPhone users are able to download many applications previously unavailable through the App Store via unofficial installers. It is estimated that 8.5% of all iPods and iPhones are jailbroken.

Every time Apple comes out with a new update for their iPhone, they find new ways to help prevent hackers from cracking their code again. Hackers then set to work to Jailbreak the iPhone again and release the new methods to the public. Is it Legal to Jailbreak an Apple iPhone or iPod?

The legality of jailbreaking an iPod or iPhone currently remains unclear. As part of the 2009 DMCA rulemaking, the Electronic Frontier Foundation asked the US Copyright Office to recognize an exemption to the DMCA to permit jailbreaking in order to allow iPhone owners to use their phones with app's that are not available from Apple's store. Apple then filed comments opposing the exemption and indicated that jailbreaking is a violation of copyright. A ruling on the proposed exemption has not yet been made, however a decision is expected sometime later in 2010.
